The legal age of consumption of alcohol in Michigan is 21. Under the Zero Tolerance provision of the OWI statute, any driver under the age of 21 who has consumed alcohol can be charged with violating the Zero Tolerance law regardless of whether the individual has a valid driver’s license. Zero Tolerance can be charged if your BAC is between .02 but less than .08. A common misconception is that minor with a BAC of .08 or higher can be charged with a Zero Tolerance offense or that an OWI charge can be reduced to a Zero Tolerance offense. Neither is permissible under the OWI statute. Of course, a prosecutor can dismiss the initial charge and reissue the ticket as a Zero Tolerance offense, however, prosecutors are often times leery of taking such action absent extraordinary circumstances.
